United States Second Circuit
US v. Lee, 15-458
Conviction of theft of government property, 18 U.S.C. section 641, is affirmed over defendant's argument that: 1) because a violation of section 641 is a felony only if the value of the property stolen exceeded $1,000, the operative indictment was ineffective to charge him with a felony because it did not allege the value of the property stolen, and thus, 2) his felony conviction violated the Grand Jury Clause of the Fifth Amendment.
