United States Second Circuit
Perez v. The City of New York, 15-315
In a collective employment action against the City's Department of Parks and Recreation, alleging violations of the Fair Labor Standards Act, including the Department's refusal to compensate them for time spent putting on and taking off (donning and doffing) required uniforms, the District Court's grant of partial summary judgment to defendants is vacated where the District Court erred both in granting partial summary judgment and in closing the case while several claims remained unresolved.
