Williams v. Correction Officer Priatno, 14-4777
In a 42 U.S.C. section 1983 case alleging that defendants violated plaintiff's Eighth Amendment rights when they brutally beat him for talking back to another officer when he was an inmate at Downstate Correctional Facility in New York, the District Court's grant of defendant's motion to dismiss is reversed where the Prison Litigation grievance was not available to plaintiff because the applicable grievance procedures are 'so opaque' and confusing that they were, 'practically speaking, incapable of use' Ross v. Blake, 136 S. Ct. 1850, 1859 (2016).
