US v. Rivernider, 13-4865

Sentences and convictions of wire fraud, 18 U.S.C. section 1343, and conspiracy to commit wire fraud, section 1349, arising from defendants' orchestration of a Ponzi scheme and a related fraudulent real estate scheme, are affirmed where: 1) the district court did not err in denying defendant's pro se motion to withdraw his guilty pleas, as there was a sufficient factual basis for defendant's plea and his conclusory allegations of attorney coercion are insufficient to justify withdrawal of his guilty plea or the appointment of substitute counsel; and 2) defendants' challenges to their sentences and to the restitution order are also without merit.
