Laroe Estates, Inc. v. Town of Chester, 15-1086

In a case in which a now-deceased land developer sued a town alleging a regulatory taking, the District Court's denial of plaintiff's motion to intervene under Rule 24 of the Federal Rules of Civil Procedure in the pending litigation is vacated where a proposed intervenor is not required to demonstrate that it has standing even when there is a genuine case or controversy between the existing parties that satisfies the requirements of Article III of the Constitution.
