United States Second Circuit

N.Y.C. & Vicinity Dist. Council of the United Bhd. of Carpenters v. Ass'n, 15-1574

In a dispute between an employer and labor union that proceeded to arbitration, the District Court's judgment vacating an award issued in the arbitration, holding that it did not draw its essence from the collective bargaining agreement (CBA) and conflicted with the court’s earlier order approving the CBA, is reversed where: 1) the award was properly grounded in the arbitrator's application of the CBA; and 2) it does not violate the approval order.
