L.O. ex rel. K.T. v. N.Y.C. Dep't of Educ., 15‐1019

In an action brought under the Individuals with Disabilities Education Act (IDEA), 20 U.S.C. sections 1400 et seq., challenging the adequacy of three individualized education programs (IEP), which were characterized by a pattern of procedural violations of IDEA committed by the defendant, and allleging these errors deprived child-plaintiff of a free appropriate public education (FAPE) for a period of three consecutive years, the District Court's judgment in favor of defendant and denial of relief under IDEA are reversed where defendant failed to offer plaintiff a FAPE for each school year.
