In a suit brought against a city by the estate of a victim who was murdered before she was scheduled to testify as a witness in a criminal trial, the District Court's grant of summary judgment to defendants is affirmed where the Court of Appeals has jurisdiction over all three of the District Court's rulings on defendants' summary judgment motions.
