United States Second Circuit
Am. Psychiatric Ass’n v. Anthem Health Plans, Inc., 14-3993
In a suit brought by psychiatrists and professional associations against health-insurance companies, alleging defendants reimbursement practices discriminate against patients with mental health and substance use disorders in violation of the Mental Health Parity and Addition Equity Act of 2008 (MHPAEA), 29 U.S.C. section 1185(a), and the Employee Retirement Income Security Act (ERISA), 29 U.S.C. sections 1001‐1461, the District Court's dismissal of the case is affirmed where: 1) the psychiatrist-plaintiffs lack a cause of action under the statute; and 2) the associations lacked constitutional standing to pursue their respective ERISA and MHPAEA claims.
