United States Second Circuit

Souratgar v. Fair, 14-904

In a family law action, the district court's award of $283,066.62 in expenses to the prevailing plaintiff under the International Child Abduction Remedies Act is reversed where the awarded expenses are "clearly inappropriate" under 22 U.S.C. section 9007(b)(3) in light of the plaintiff's multiple, unilateral acts of intimate partner violence against defendant and their relation to her removal of their child from the habitual country.
