Avila v. Riexinger & Associates LLC, 15-1584
In a debt collection action, the district court's dismissal of plaintiff's claims under the Fair Debt Collection Practices Act (FDCPA) is reversed. The court held that 15 U.S.C. section 1692e, of the FDCPA, requires debt collectors to disclose that the balance of a debt may increase due to interest and fees when notifying consumers of their account balance.
