Graziadio v. Culinary Institute of America, 15-888
In an employment action, brought by a former employee of defendant under the Family and Medical Leave Act (FMLA) and the Americans with Disabilities Act (ADA) after being fired for taking leave to care for her children, the district court's grant of summary judgment to defendant is: 1) vacated in part where plaintiff has raised genuine issues of material fact with respect to her FMLA interference and retaliation claims; and 2) affirmed in part where plaintiff has failed to adduce evidence supporting her discrimination claim under the ADA.
