United States Second Circuit

Harris v. Fischer, 14-2957

In an action brought by former prisoner, alleging that three female corrections officers held her down while a male corrections officer visually inspected her genitalia in search of cotton, the district court's grant of summary judgment to defendants is vacated where: 1) the district court's conclusions rested on an incomplete assessment of the Fourth Amendment's protection of an inmate's right to bodily privacy; and 2) there are genuine disputes of material fact remaining.
