US v. Tulsiram, 14-2483

Conviction for sexual exploitation of a minor, transportation of child pornography, and possession of child pornography is affirmed where: 1) a judgment of conviction is final for purposes of 28 U.S.C. section 1291 whenever it imposes a sentence of incarceration, even if post-conviction restitution proceedings remain pending; and 2) the district court’s failure to advise defendant that restitution would be imposed when he pleaded guilty did not constitute plain error.
