In a securities action, alleging that pharmaceutical company Sanofi made materially false or misleading statements to investors regarding the pharmaceutical drug Lemtrada, the district court’s dismissal under F.R. Civ. Pro. 12(b)(6) for failure to state a claim is affirmed where no reasonable investor would have been misled by defendant’s statements under the standards articulated in Omnicare, Inc. v. Laborers Dist. Council Const. Indus. Pension Fund, 135 S. Ct. 1318 (2015).
