United States Second Circuit

US v. Prado, 13-2894

Convictions for aiding and abetting a violation of 18 U.S.C. section 924(c) in furtherance of the murder of Mario Alberto Canton Quijdada are reversed as to one defendant but affirmed as to another defendant. The court held that following Rosemond v. U.S., 134 S. Ct. 1240 (2014), general jury instructions on aiding and abetting liability are insufficient and plainly erroneous in the context of a section 924(c) charge.
