In a class action, the district court’s denial of class certification and dismissal of claims for lack of standing is affirmed where: 1) The New York Court of Appeal has concluded that plaintiff Commerzbank does not having standing to pursue its fraud claim under New York law; and 2) the district court did not abuse its discretion denying plaintiff’s Fed. R. Civ. P. 17(a)(3) motion as untimely.
