US v. Viloski, 14-4176
Conviction related to running a kickback scheme in developing and constructing Dick's Sporting Goods stores is affirmed where the district court's forfeiture order of $1,273,285.50 was not unconstitutional under the Excessive Fines Clause. The court held that a reviewing court may consider whether a forfeiture would deprive a defendant of his future ability to earn a living as part of the proportionality prong of U.S. v. Bajakajian, 524 U.S. 321 (1998).
