US v. Bert, 14-2428
Conviction for possessing a firearm with an obliterated serial number and being a felon in possession of a firearm and ammunition is: 1) affirmed where the police had reasonable suspicion to believe defendant was trespassing in an apartment building at the time of his detention, based on the physical description of the suspects and a security guard's direction to their location; and 2) remanded for the district court to reexamine whether the uncontested violation of defendant's Speedy Trial Act rights require a dismissal of the indictment with prejudice.
