Atlantica Holdings v. Sovereign Wealth Fund Samruk-Kazyna JSC, 14-917

In a securities action brought by American plaintiffs alleging that defendant, a Kazakhstani sovereign wealth fund, misrepresented the value of certain notes issued by a third party corporation in violation sections 10(b) and 20(a) of the Securities Exchange Act 1934, the court: 1) affirmed the district court's decision that defendant is not immune from suit under the Foreign Sovereign Immunities Act of 1976; and 2) declined to exercise appellate jurisdiction in this interlocutory appeal over defendant's claim that the district court's exercise of personal jurisdiction over it was inconsistent with due process.
