US v. Vernace, 14-21987

Conviction for conspiring to engage in a racketeering enterprise in violation of the RICO statute, carrying a firearm in relation to a crime of violence, and operating an illegal gambling business in connection with the 1981 "Shamrock Murders" in Queens, New York is affirmed where: 1) there was sufficient evidence to convict defendant under RICO; 2) convicting defendant under the post-1998 version of 18 U.S.C. section 924(c) was not clear or obvious error and was harmless; and 3) defendant is not entitled to a new trial because a prosecution witness violated his cooperation agreement through illegal gambling.
