United States Second Circuit

US v. Pruitt, 14-1921

Conviction and sentence for being a felon in possession of a firearm is affirmed where the district court properly explained the reasons for the sentence as required by 18 U.S.C. section 3553(c). The panel suggested that Form AO 245B, specifically the portion where a sentencing judge can check-a-box to sentence within the guidelines simply because the judge find no reason to depart from them, be amended to comply with section 3553(c).
