Victory v. Pataki, 13-3592

In a 42 U.S.C. section 1983 action raising due process claims with regard to the rescission of plaintiff's grant of parole, the district court's grant of summary judgment to defendants is vacated in part where: 1) A New York parole grantee possesses a liberty interest protected by the Due Process Clause; and 2) there are genuine issues of material fact remaining with respect to the personal involvement of certain defendants in connection with the rescission of plaintiff's grant of parole.
