United States Second Circuit

Tann v. Bennett, 14-4734

In an action filed under the International Child Abduction Remedies Act, 22 U.S.C. section 9001 et seq., implementing the Hague Convention on Civil Aspects of International Child Abduction, the court denied defendants' motion to dismiss the appeal as moot where a New York state court judgment granting full custody to defendant did not render the action moot because doing so would encourage jurisdictional gerrymandering contrary to the design of the Hague Convention.
