In an action challenging the constitutionality of defendant's municipal code regulating adult-oriented establishments, the district court's judgment is affirmed in part and reversed in part where: 1) the district court's consideration of an affidavit of the Milford Chief of Police in granting partial summary judgment to defendants was not an abuse of discretion; and 2) plaintiff lacks Article III standing as there is no justiciable case or controversy presented.
