Breecher v. Republic of Argentina, 14-4385
In a class action seeking damages from defendant Argentina for its 2001 default on sovereign debt, the district court's order modifying the class definition after having granted summary judgment on the merits in order to calculate damages is reversed where removing the continuous holder requirement for the class definition of bondholder plaintiffs violated the requirement of ascertainability in Fed. R. Civ. Pro. Rule 23.
