United States Second Circuit

Gomez v. City of New York, 14-3583

In a civil action alleging assorted constitutional violations stemming from plaintiff's arrest and detention, the district court's denial of plaintiff's motion to reopen his case after settlement is vacated and the case remanded where an evidentiary hearing was necessary to determine whether plaintiff's attorney had his client's authority to enter a settlement dismissing most of his claims.
