In an action alleging that defendant's housing policies perpetuated racial discrimination and had a disparate impact on African American families, in violation of the Fair Housing Act, 42 U.S.C. section 3604, the court: 1) reversed the district court's order of a new trial following a $1 million jury verdict for plaintiff because defendant waived its argument that the jury verdict was inconsistent; 2) reinstated the jury's verdict concerning the disparate impact claim alone; and 3) ordered a new trial on damages unless plaintiff agreed to accept remittitur to $100,000.
