Authors Guild v. Google, Inc., 13-4829

In a copyright infringement action contending that Google's Library Project and Google Books project infringe on the copyrights of plaintiff authors, the district court's grant of summary judgment to defendant is affirmed where: 1) Google's digital copying and search functionality is a transformative use within the meaning of Campbell v. Acuff-Rose Music, Inc., 510 U.S. 569 (1994); and 2) constitutes fair use under 17 U.S.C. section 107.
