In an action filed after plaintiff was dismissed from the M.D. program at the University at Buffalo School of Medicine and Biomedical Sciences, the district court's grant of summary judgment for the defendants is affirmed in part and vacated in part where: 1) a trier of fact could find defendants did not grant plaintiff reasonable accommodation under Title II of the Americans with Disabilities Act, 42 U.S.C. section 12132, and discriminated against plaintiff under the Rehabilitation Act, 29 U.S.C. section 794; and 2) defendant's notice of potential termination from the M.D. program and careful and deliberate decision satisfied procedure due process.
