Gonzalez v. Hasty, 13-2844

In a suit arising out of plaintiff's confinement in the Special Housing Units of the Metropolitan Correctional Centers in Manhattan and the Brooklyn, the district court's dismissal of plaintiff's First, Fifth and Eighth Amendment Bivens claims is: 1) affirmed in part where the court correctly applied the three-year statute of limitations to plaintiff's First Amendment claim; but 2) vacated where the court erred in holding that plaintiff's Fifth and Eighth Amendment claims are time-barred in their entirety.
