United States Second Circuit

US v. Cohan, 14-127

In a writ of garnishment hearing seeking that certain monies owned by defendant but in control of third parties be transferred to the US to satisfy defendant's restitution obligations, the district court's judgment in favor of the government is affirmed where: 1) there is no Sixth Amendment right to counsel at a writ of garnishment hearing brought to satisfy forfeiture or restitution judgments; and 2) the district court did not have a duty to inquire into the alleged conflict of interest that defendant's attorney labored under.
