United States Second Circuit
Hart v. FCI Lender Services, Inc., 14-191
In a borrower's putative class action suit against his lender, seeking damages under the Fair Debt Collection Practices Act (FDCPA), 15 U.S.C. section 1692 et seq., for sending certain communications without providing statutorily required information about his debt, the district court's grant of defendant's motion to dismiss for failure to state a claim is reversed where vacated where, construing the FDCPA in light of its remedial purposes, plaintiff has adequately alleged that defendant sent the letter "in connection with the collection of [a] debt," thereby triggering the FDCPA's initial notice requirements.
