United States Second Circuit

US v. Cosme, 14-1625

In an action challenging the government's restraint upon defendant's property, including his cars and two bank accounts, during his prosecution for wire fraud charges, the district court's denial of defendant's motion to vacate the seizure order allowing the government to hold the seized property until the conclusion of the criminal case is vacated where exigent circumstances do not support the government's indefinite seizure in the absence of a warrant.
