Sewell v. Bernardin, 14-3143

In an action brought under the Computer Fraud and Abuse Act, 18 U.S.C. section 1030, and the Stored Communications Act, 18 U.S.C. section 2701, arising out of defendant's alleged acts of gaining unlawful access to plaintiff's AOL email and Facebook accounts, the district court's dismissal of her claims is: 1) affirmed where the court correctly applied the two-year statutes of limitations to plaintiff's claims for unlawful access with respect to her e-mail account; but 2) reversed where the court erred in holding that plaintiff's claims with respect to her Facebook account were time-barred.
