In a putative securities class action brought by five employee retirement systems that purchased or otherwise acquired common stock in defendant, the manufacturer of the Keurig single‐cup brewing system, alleging fraud claims, the district court's grant of defendants-appellees' motions to dismiss is vacated and remanded where the complaint sufficiently alleges misleading statements of material fact and a compelling inference of scienter.
