Okun v. Montefiore Medical Center, 13-3928
In an action brought by a physician against his employer, challenging the denial of severance benefits in violation of the Employee Retirement Security Act of 1974 (ERISA), the district court's dismissal of the complaint on grounds that it lacked subject matter jurisdiction is reversed where, on the facts alleged, the severance policy was a "plan" governed by ERISA.
