Cortlandt St. Recovery Corp. v. Hellas Telecommunications, S.à.r.l., 13-3325
In an action to collect money owed to plaintiff under defaulted "Subordinate Notes" issued in 2006 by a now-dissolved entity, the district court's dismissal of plaintiff's claims without prejudice is affirmed where: 1) plaintiff lacked Article III standing to bring the claims at issue; and 2) the court did not err in denying plaintiff's request to cure this standing defect under Fed. R. Civ. P. 17(a)(3).
