Bermudez v. City of New York, 14-1125
In a suit under 42 U.S.C. section 1983 brought by a man incarcerated 18 years for a murder he did not commit, alleging due process violations and malicious prosecution, the district court's grant of summary judgment to defendant officers is: 1) affirmed in part where there are no genuine issues of material fact concerning plaintiff's malicious prosecution claims; and 2) vacated in part where there are genuine issues of material fact concerning the due process claims.
