In an action to prevent the California Department of Justice from listing plaintiff's name and information concerning a sexual offense that he committed (committing a lewd act on his stepgranddaughter in violation of Penal Code section 288(a)), on its Megan's Law Internet Web Site, the trial court’s denial of the petition is affirmed where: 1) the exclusion provided in section 290.46(e)(2)(D)(i) does apply to stepgrandparents; and 2) section 290.46(e)(2)(D)(i) is constitutional.
