United States Second Circuit
US v. Johnson, 14-1063
Imposition of a 36-month term of incarceration after defendant violated a condition of his supervised release is affirmed over claims that the court erred in determining the maximum term of incarceration for his supervised release violation by reference to the felony classification of his underlying offense at time of its commission, instead of classification at the time of his supervised release revocation proceedings.
