Santiago-Monteverde v. Pereira, 12‐4131
Decision of the district court affirming the bankruptcy court's ruling that the debtor's rent-stabilized residential lease was not exempt from her bankruptcy estate as a "local public assistance benefit" within the meaning of New York Debtor and Creditor Law (DCL) section 282(2) is reversed and the case is remanded, where: 1) a debtor's interest in a rent-stabilized lease is a local public assistance benefit under the DCL; and 2) the debtor is therefore allowed to claim her rent-stabilized lease as an exemption from her bankruptcy estate.
