Sykes v. Mel S. Harris and Associates, 13-2742-cv

Order certifying two classes, the first pursuant to Rule 23(b)(2) of the Federal Rules of Civil Procedure and the second pursuant to Rule 23(b)(3), each comprised of plaintiffs asserting claims under the Racketeer Influenced and Corrupt Organizations Act (RICO), the Fair Debt Collection Practices Act, New York General Business Law section 349, and New York Judiciary Law section 487, is affirmed, where: 1) the district court properly concluded that, while individual issues existed in this case, they did not predominate over common issues; and 2) relief to each member of the class need not be identical, it need only be beneficial.
