Kirschenbaum v. U.S. Department of Labor, 14-1144
In an appeal to determine whether bankruptcy courts have jurisdiction to award compensation to a Chapter 7 bankruptcy trustee and his retained professionals out of assets in a 401(k) plan governed by ERISA, the District Court's decision is affirmed where no "arising under," "arising in" or "related to" jurisdiction exist that would allow the bankruptcy court to make such an award.
