US v. Kimber, 13‐3661
Sentence and conviction for use and possession of a chemical weapon, in violation of 18 U.S.C. Section 229(a)(1), and consumer product tampering, in violation of 18 U.S.C. Section 1365(a), are affirmed where: 1) Section 229(a)(1) does reach defendant's conduct, even in light of the U.S. Supreme Court's decision in Bond v. US, 134 S. Ct. 2077 (2014); and 2) the sentence adjustments were proper.
