United States Second Circuit
Smith v. County of Suffolk, 13-1230-cv
In this First Amendment employment retaliation case, judgment granted summary judgment against plaintiff police officer and dismissing his case is vacated and remanded for further proceedings, where: 1) the record contains evidence connecting plaintiff's protected speech to the adverse employment actions sufficient to give rise to genuine questions of material fact; and 2) defendants fail to proffer evidence warranting summary judgment on the basis that those adverse actions would have occurred absent plaintiff's protected speech.
