United States Second Circuit

US v. Norman, 13-2840

In this case, defendant was convicted of conspiracy to commit wire fraud and sentence to 20 years' imprisonment. Defendant challenges his sentence, arguing that the court improperly increased his Guidelines offense level for number of victims, amount of loss, and leadership role based principally on his testimony at trial, while simultaneously increasing his offense level on grounds that defendant committed perjury at trial. The judgment is affirmed, where the court properly credited certain parts of defendant's trial testimony while finding other parts perjurious.
