US v. Banks, 13‐3473

Judgment sentencing defendant to 57 months' imprisonment for unlawful possession of a firearm by a convicted felon is affirmed, where: 1) the district court calculated defendant's criminal history category and base offense level by relying on prior sentences imposed upon pleas entered in accordance with North Carolina v. Alford; and 2) a sentence imposed upon entry of an Alford plea qualifies as a "prior sentence" under U.S.S.G. section 4A1.2(a)(1).
