Vossbrinck v. Deutsche Bank National Trust Co., 12-3647-cv (L)
In this case, plaintiff brought suit against defendants for fraud, perjury, forgery, predatory lending, negligent misrepresentation, unjust enrichment, violations of the Truth in Lending Act, Real Estate Settlement Procedures Act, and the Connecticut Unfair Trade Practices Act. Judgment as to the fraud claims is vacated and remanded, and dismissal of plaintiff’s non-fraud claims is affirmed, where: 1) though the district court lacks jurisdiction over certain of plaintiff’s fraud claims under the Rooker-Feldman doctrine, the district court should have remanded the barred claims to state court instead of dismissing them on the merits; and 2) plaintiff has waived any challenge to the district court’s collateral estoppel and timeliness rulings on the non-fraud claims.
