Community Health Care Association of New York v. Shah, 13‐771

In this action, plaintiff Federal Qualified Health Centers (FQHCs) seek injunctive relief to remedy supposed methodological shortcomings of Medicaid reimbursement for FQHCs. Summary judgment in favor of defendant Commissioner of the New York State Department of Health is: 1) affirmed with respect to the methodologies for reimbursing FQHCs and reimbursement for services provided to Managed Care Organization (MCO) enrollees; and 2) vacated in part and remanded with respect to to defendant's methodology for calculating its prospective obligation to make a wraparound payment to FQHCs that provide services pursuant to a contract with an MCO.
